Amnesty Anyone?

We’ve seen limited amnesty programs over the previous years; however, there are an abundance of programs this Fall. September and October seem to be the months for Amnesty.. If you have non-reported, under reported and non-payment of sales tax liabilities, now is the time to work with the states to take advantage of some penalty and interest breaks. It’s the right time to get sales tax compliant!tax_life_preserver

Below are the states offering sales tax amnesty, the amnesty period and website links to the specific programs:
  • Arizona: Arizona Department of Revenue has announced that they will offer an amnesty program from September 1, 2015 – October 1, 2015 and will include all tax types. Navigate to the following website for additional information: https://www.azdor.gov/TaxRecovery.aspx

  • Indiana: Indiana Department of Revenue will be running a tax amnesty program from September 15, 2015 – November 16, 2015 for individual and business tax types for periods prior to January 1, 2013. Additional information related to Tax Amnesty 2015 can be found at www.taxamnesty.in.gov.

  • Kansas: Kansas Department of Revenue will be accepting amnesty applications on September 1, 2015 for a tax amnesty program for tax liabilities due and unpaid for tax periods ending on or before December 31, 2013. The program will run from September 1, 2015 – October 15, 2015. Additional information can be found at: http://www.ksrevenue.org/taxamnesty.html

  • Louisiana: The Louisiana Department of Revenue has announced that Tax Amnesty will return this fall. While the dates have not been announced, check out the LA Amnesty website, http://ldrtaxamnesty.com/.

  • Maryland: The Maryland House of Delegates has joined the Maryland Senate by passing H1233 which provides tax amnesty for certain penalties and interests relating to state sales and use tax. The waiver of penalties and interest would apply to the non-reporting, underreporting, and nonpayment of tax liabilities. The amnesty program dates are September 1, 2015 – October 30, 2015.   • Missouri: The Missouri General Assembly passed H384 which authorizes an amnesty from the assessment or payment of all penalties, additions to tax, and interest on delinquencies of unpaid taxes administered by the Department of Revenue which occurred on or prior to December 31, 2014. The tax amnesty period would occur from September 1, 2015, to November 30th, 2015, and a taxpayer would need to apply for amnesty, file tax returns for each taxable period for which amnesty is requested, and pay the entire balance owed by November 30, 2015. In addition, taxpayers must agree to comply with the state tax laws for the next eight years from the date of the amnesty agreement. Taxpayers granted amnesty will not be eligible to participate in any future amnesty for the same type of tax. http://dor.mo.gov/faq/amnesty.php

  • Oklahoma: Oklahoma DOR has announced their amnesty program effective September 14, 2015 – November 13, 2015. For additional information check out: http://www.oklegislature.gov/BillInfo.aspx?Bill=HB%202236.
